1. Scope and contracting party
1.1 These Terms and Conditions apply to all contracts for the purchase of goods that a consumer concludes with [FIRMENNAME GmbH], [Straße Hausnummer], [PLZ] [Ort], Deutschland (“we” or “bloomda”) through the online shop [https://www.bloomda.de].
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). Our offer is directed exclusively at consumers with a delivery address in Germany or Austria.
1.3 Conflicting, deviating or supplementary terms and conditions of the customer do not form part of the contract unless we expressly agree to their application in writing.
2. Conclusion of contract
2.1 The presentation of products in the online shop is not a binding offer, but a non-binding invitation to the customer to submit an offer.
2.2 The ordering process works as follows:
- You add the desired products to the cart and can review and change your cart at any time.
- During checkout, you enter your e-mail address and delivery and, where applicable, billing address, and select the shipping method and payment method. A customer account is not required.
- On the last page of the checkout you see a summary of your order with the essential characteristics of the goods, the total price including VAT and shipping costs, the selected payment method, and information on your right of withdrawal and the statutory warranty. Before placing your order, you can identify and correct input errors using the usual functions of your browser and the editing options in the checkout.
- By clicking the button “Place order and pay” you submit a binding offer to buy the goods in the cart.
2.3 After you place your order, we send you an e-mail with a summary of the order, the order number, the contract terms (these Terms and Conditions), the instructions on withdrawal and the model withdrawal form (order confirmation).
2.4 The purchase contract is concluded when we accept your order by sending this order confirmation by e-mail. Displaying the order on the order completion page of the online shop is not yet an acceptance.
2.5 We are entitled to decline an order, in particular if the goods are not available, payments fail or are charged back, a price is obviously incorrect, or the delivery address is outside our delivery area. If no order confirmation is sent, no contract is concluded; any payment or authorisation already made will be refunded or released without delay. We are not bound by your offer for longer than [five (5) days].
2.6 Order processing and all communication required for the conclusion of the contract take place by e-mail. You must ensure that the e-mail address you provide is correct and that e-mails from us can be received (including spam filters).
3. Contract language and storage of the contract text
3.1 The contract languages are German and English. The language in which you place your order in the online shop prevails. In case of discrepancies between language versions of these Terms and Conditions, the German version prevails.
3.2 We store the contract text (your order with the contract data) and send you the order data and these Terms and Conditions with the order confirmation by e-mail. You can view and print these Terms and Conditions at any time at terms and conditions. If you have a customer account, you can view your past orders there. For security reasons, the contract text itself is not accessible to third parties.
4. Prices, shipping costs and taxes
4.1 All prices stated are total prices in euros and include statutory VAT (currently 19 % for delivery to Germany and 20 % for delivery to Austria). The applicable tax rate is shown during checkout.
4.2 In addition to the product prices, shipping costs apply; they are shown in the cart and during checkout before you place your order. Details (amount, free-shipping threshold, shipping methods) are available under Shipping & payment. For delivery to Germany, shipping costs are 4,90 € for DHL Standard (free of shipping charges from 49,00 € order value) and 9,90 € for DHL Express.
4.3 For goods offered by weight or volume, we also state the unit price per 1 kilogram or 1 litre.
5. Delivery
5.1 We only deliver to addresses in Germany and Austria.
5.2 Delivery is made by DHL. The expected delivery time after dispatch is [1–3 Werktage] within Germany and [2–5 Werktage] to Austria. We usually dispatch within [1–2 Werktage] after the contract is concluded and – for payment methods requiring prior payment – after receipt or release of payment.
5.3 If ordered goods are not available, we will inform you without delay. We may make reasonable partial deliveries; no additional shipping costs arise from this.
5.4 If delivery has not taken place even after a reasonable additional period set by you, your statutory rights apply. The risk of accidental loss or deterioration of the goods passes to you once the goods have been handed over to you or to a recipient designated by you (§ 475 (2) BGB).
6. Payment
6.1 You can pay using the payment methods offered during checkout. Currently, depending on country, device and order value, these are: credit/debit card, Apple Pay, Google Pay, Klarna (e.g. invoice, instalments, pay now), SEPA direct debit and PayPal. Payments are processed by Stripe Payments Europe, Limited, Ireland. Details on the payment methods and when your payment is charged are available under Shipping & payment.
6.2 When paying with Klarna, Klarna’s payment terms additionally apply. Klarna decides which Klarna options are available.
6.3 If a direct debit is returned or a payment is charged back for reasons you are responsible for, we are entitled to claim reimbursement of the bank charges actually incurred. You remain free to prove that the damage is lower.
6.4 We provide invoices electronically (PDF) by e-mail.
7. Retention of title
The delivered goods remain our property until full payment has been made.
8. Right of withdrawal
Consumers have a statutory right of withdrawal. Details, the consequences of withdrawal, the exceptions to the right of withdrawal and the model withdrawal form are in the instructions on withdrawal. You can also declare your withdrawal online at Withdraw from contract.
9. Statutory warranty
9.1 The statutory warranty for defects applies. For new goods it is two years from delivery of the goods. If a defect becomes apparent within twelve months of delivery, it is presumed under the statutory rules that the goods were already defective at delivery. We show you the harmonised EU notice on the statutory warranty in the online shop before you place your order.
9.2 In case of a defect you can first choose between repair and replacement; under the statutory conditions you may withdraw from the contract, reduce the purchase price or claim damages.
9.3 Please report defects as soon as possible at [kontakt@bloomda.de] (stating the order number and, if possible, photos of the defect). This is not a condition for your statutory rights.
9.4 Cosmetic products are consumables. An individual intolerance or subjective dislike (e.g. scent, texture, effect) is not a defect. Please observe the directions for use and warnings on the packaging and product page; if you have known allergies, please check the ingredient list (INCI) before buying.
9.5 We only give guarantees where we expressly declare them in individual cases. Statutory rights remain unaffected.
10. Liability
10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and, where we have given a guarantee, in accordance with that guarantee.
10.2 In case of slightly negligent breach of essential contractual obligations (obligations whose fulfilment is necessary for the proper performance of the contract and on which you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
10.3 The above limitations of liability also apply in favour of our legal representatives and vicarious agents.
11. Data protection
Information on how we process your personal data is in our privacy policy.
12. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act. The former European online dispute resolution platform (ODR platform) was discontinued on 20 July 2025.
13. Governing law, jurisdiction, final provisions
13.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the state in which they have their habitual residence (in particular Austria).
13.2 For actions by consumers, the statutory places of jurisdiction apply; we do not choose a different place of jurisdiction. Consumers with habitual residence in Germany or Austria may bring proceedings at their place of residence.
13.3 Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected; the statutory provision replaces the invalid provision (§ 306 BGB).
